A tribunal has ruled that a dinner lady, who was sacked after telling a couple that their daughter was being bullied, was unfairly dismissed from her job.

Carol Hill was sacked from her job at Great Tey Primary School in Essex after she discovered Chloe David, aged seven, tied to a fence and being whipped with a skipping rope by four boys. She dragged the boys away and later told Chloe’s parents about the incident.

She was suspended for telling the parents out of school and was later sacked when she went public and the case was highlighted in the national media. During the tribunal hearing she argued that she had not been given a correct notice period and also said that her rights to Freedom of Expression under European Law had been infringed.

The tribunal said that a remedy hearing would take place next month to determine whether Mrs Hill would get her job back or receive compensation.
